TERMS AND CONDITIONS OF SEASONAL CAMPING PERMIT

____________________________) hereinafter referred to as the "CAMPER", having a permanent residence shown on Page 5, applies for a seasonal camping permit within Crystalrock Campround) hereinafter referred to as the "RECREATIONAL CAMPGROUND". When approved, this permit will authorize occupancy of site#________for your RV from April 1st, 2011 through October 31st, 2011, the availability of services and or vehicular access to any particular site is subject to this permit, campground rules and regulations and the weather conditions during the camping season. Campsites are intended for temporary occupancy for recreational dwelling purposes only, and not for year round residency.
1. In consideration of $ 1800__ Seasonal registration fee, ($100 Dollars of which is to be given as an electrical deposit.) which entitles the Camper and family members listed below to camp, but not reside within the Recreational Campground, subject to the conditions set forth in this application. The electrical deposit will be returned after the final electrical bill of the season has been paid.
Upon arrival, a completed Seasonal camping permit and $ _950___will be due, the balance of $_850__being due on or before July 1st, 2011, optional winter storage will be an additional $_100_ and may require the camping unit to be moved.
In the event the remaining balance due is not received by July 1st, 2011, any deposit will be forfeited and the space will be reassigned, the camper's personal property may be placed in storage and disposed of in accordance with RSA 216-I:7.
The camper understands and acknowledges that the term of this contract
encompasses the normal camping season from April 1st, 2011 to October 31st, 2011
when full services will be available,
Winter Storage will begin November 1st 2011, and runs through April
1st, 2012, This period allows for limited services and limited access due to
weather conditions. (additional $100.00 winter storage fee)
§ 216-I:7 Storage of Property.
- Any property left in a recreational campground or camping park after check-out time or eviction pursuant to RSA 21.6-1:6 shall be considered abandoned. Such abandoned property may then be moved off the campsite and placed in storage. Any owner or operator or their agent of a recreational campground or camping park shall have. a lien upon such property, so long as it shall remain in their possession, for proper charges due them for the storage and care o/the property.Source. 1989, 343:1, eff June 2,1989.

2. Site assignment is made at the sole and absolute discretion of the Recreational Campground and may be changed without cause at any time prior to occupancy without notice, and subsequent to occupancy upon twenty-four (24) hours notice. In giving such 24 hours notice, the Recreational Campground shall attempt to contact the Camper by telephone at the number listed below and by positing a notice of intent to change sites at the Campers initial site. If the Camper does not consider the second site acceptable and wishes to terminate the camping permit, a prorated refund based upon the normal season and the number of days occupancy will be made. The Recreational Campground shall also have the right to revoke this permit for cause; for violation of city, town, state or federal laws or regulations; for any breach of this permit or the rules and regulations of the Recreational Campground; for the presentation of false or misleading information in this application; or for checks written from the Camper to the Recreational Campground being returned for insufficient funds. Revocation of this permit shall be cause for immediate eviction.
3. In the event of termination for cause, refunds shall be made in accordance with RSA 216-I:6.II which states; "Following eviction, said person may make written request to the owner or operator or their agent of such recreational campground or camping park within 30 days for the refund of the unused portion of his prepaid campsite rental or visitor fee. Upon such a request, such owner or operator shall refund such unused portion of the fees, less any amount deducted to pay for damages. "
4. The Camper agrees that when the Recreational Campground site is unattended for a period longer than twenty-four (24) hours all property and equipment on the site will be secured in such fashion that the Recreational Campground will be able to move or relocate the same if the need arises. If the Camper, after having been notified as set forth above of a change in sites or the termination of his or her permit, fails, within twenty-four (24) hours of said notice, to remove the property or equipment located thereon, or in the event of emergency, the Recreational Campground may, at its sole and absolute discretion, move said property and equipment to an alternative site or storage area, and the Recreational Campground shall be entitled to reasonable compensation for moving said property and equipment.
5. If the property is placed in storage, a fee of $5.00 per day will be charged..
6. The Camper acknowledges and recognizes the unique nature of camping and Recreational Campgrounds where the desire for individual freedom, a relaxed atmosphere and the lack of restriction on activities conflict with the establishment of security measures. Under these circumstances, it is essential that each individual be responsible for his or her person or property whether on an assigned site, in storage areas or elsewhere on the Recreational Campground. The Camper assumes the risks associated with camping with the understanding that the Recreational Campground permits the use of its space but cannot and does not accept responsibility for the general security of the person or property of the users. The Camper accepts and assumes complete responsibility for articles lost, damaged or stolen. The Recreational Campground is not responsible for articles lost, damaged or stolen.

7. The Camper agrees to abide by the terms and conditions of this permit and the rules and regulations of the Recreational Campground as they may be from time to time amended. The Camper acknowledges receipt of a copy of the existing rules and regulations and agrees to be responsible for reviewing those rules and regulations with all members of his or her family, visitors or guests.
The use of any equipment or facilities of the Recreational Campground by the Camper, members of his or her family, visitors or guests is done so at their own risk and the Camper agrees to save and hold harmless, and indemnify the Recreational Campground from and against all loss, liability and expense that may be incurred by the Recreational Campground by reason of such use, or in connection therewith.
8. The Camper shall be fully responsible for ensuring that members of his or her family, visitors and guests adhere to the applicable provisions of RSA 216-1:5, this permit, and the rules and regulations of the Recreational Campground. The Camper further agrees that the specific individuals who will occupy the campsite during this season are listed below, and agrees to insure that in accordance with RSA 216-1:5 guests or visitors are registered upon their arrival. Payment of guest or visitors fees must be made in advance or upon arrival. Failure to register guests or visitors or to pay the required fee may result in revocation of this permit as set forth above, except as shown on page 5, no Recreational Vehic1es, or other vehicles shall be allowed without prior approval, and an amendment to this permit.
§ 216-1:5 Registration. -All persons upon entering a recreational campground or camping park shall register with the- appropriate authorities. All recreational campground or camping park owners or operators or their agents shall upon the registration of each camper or camper's guest cause an entry to be made on a registration book or card system which shall record the campers' or camper's guests' agreed-upon departure time and date. No camper or camper's guest shall without the consent of the campground or camping park owner or operator or his agent remain on a campsite beyond the departure time and date so recorded at registration.

9. The Camper shall be responsible for ensuring that the site assigned is kept in a sanitary condition and free of litter and other unsightly property. Alterations of the campsite i.e.; cutting of trees or vegetation, moving of fireplaces, electrical lines, or water lines is prohibited. Nothing
shall be constructed on the site without prior approval of the owner/operator of the Recreational
Campground. Any permanent structure erected on a site will become the property of the campground upon the campers’ departure from the campground, i.e. electrical poles, cemented fire pits, any structure that would deface campground property upon removal, etc.
10. The Camper agrees to carry and maintain in full force and effect adequate property damage and liability insurance on any vehicle or recreational vehicle brought within the Recreational Campground.

11. The Parties specifically agree that the Recreational Campground is intended for
TEMPORARY RECREATIONAL OCCUPANCY ONLY. It is NOT A MANUFACTURED HOUSING PARK and it is NOT A RESIDENCE, and Camper shall not make it a residence. This is a camping permit, it is NOT A LEASE, and Camper acknowledges that it creates no rights of tenancy for any campers using this site.
12. I/ we understand that we are responsible for paying for our electricity that will be supplied by Crystalrock Campground to our site. The bill will be calculated by the Campground based on the monthly bill provided by Ohio Edison. The bill will be paid by the camper named in this permit in a timely fashion, the penalty for not paying in a timely fashion is that a deposit of 100.00 dollars will be assessed and used as needed to pay the electric bill. If there are further problems with payment the camper’s contract will be revoked and the camper and their property will be evicted from the campground. The amount of the outstanding electric bill will be deducted from any refund due the camper.
I/we certify that I/we have read, understand and agree to the terms and conditions of this seasonal camping permit, that I/we can be reached when not at the Recreational Campground at the telephone number and address indicated on Page 5; that the following vehicles and/or recreational vehicles will be on the site during this season, and that I/we will notify the Recreational Campground in writing of any changes in this information, and request an amendment to this permit.
